Can Businesses Still Have Independent Contractors In CA?
Assembly Bill 5, currently pending in the California legislature, would codify into the state Labor Code the ?ABC Test" for determining whether a worker is an employee or an independent contractor. If passed into law, the new test would reclassify as employees hundreds of thousands of Californians who currently operate as independent contractors. The impact on California's economy ? the fifth largest in the world ? could be extraordinary.
To address the myriad of potential legal and practical issues presented by this bill, Littler's Workplace Policy Institute has created a Task Force of subject matter experts in independent contractor and wage and hour law to evaluate, analyze, and report on the ABC Test and its possible adoption in California. This webinar, and an accompanying detailed Task Force Report, are two of the products of the efforts of this group.
Topics covered in the one-hour webinar will include:
- An overview of the ABC Test
- An analysis of the provisions of AB 5
- A discussion of the potential impacts on the state economy and businesses should the bill be passed into law
- Practical suggestions for California employers to address the numerous challenges presented by this possible change in the law
